Zolari Trends ("Zolari Trends") owns the copyright to the Zolari Ventures LLC, which can be found at www.zolariventures.com. Online retailers like Zolari Trends provide something unique every day.

You agree to and accept these Terms and Conditions by selecting "sign in" and using our website or mobile applications (the "Web site") in any other way.

 

Additionally, you acknowledge and agree to our Notice of Privacy Practices, which explains how we use the information you give Zolari Trends and is included by reference into these terms and conditions.

 

Because you are committing to their terms, please carefully read both the Terms & Conditions and our Notice of Privacy Practices.

(1) Accounts

Account Establishment. You must register for a Zolari Trends account ("Solari Trends Account") and submit the requested information on the website registration form in order to use some features of the website, such as purchasing goods and services (collectively referred to as "Products" herein).

 

You affirm and guarantee that (a) any mandatory registration information you provide is true and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the website does not conflict with any provisions of this Agreement or any other law or regulation that may be in force.

 

By unchecking the e-mail preference box in the "My Account" part of the website, you can deactivate your Zolari Trends Account whenever you want, for any reason. According to Section 11, Zolari Trends may suspend or close your Zolari Trends Account.

Account Responsibility 1.2. Your login credentials for your Zolari Trends Account must be kept secret at all times. You are solely responsible for all actions taken in connection with your Zolari Trends Account, whether they involve purchases, website usage, or communications with Zolari Trends.

 

You consent to alert Zolari Trends right away of any suspected or actual security breach or unauthorized use of your Zolari Trends Account. When you give Zolari Trends this notice, Zolari Trends will put your account on hold or take other security measures to stop future unwanted activity.

Conditions of Sale

Products and Price. The availability, pricing, and information regarding any Product or Service listed on the website are all liable to change. Prior to accepting your order (as outlined in Section 2.3 below), we reserve the right to refuse or cancel any orders placed for Products that are listed at an incorrect price or with incorrect information.

 

This applies regardless of whether the order has been confirmed and/or your credit card or PayPal account charged. If we cancel your order after charging your credit card or PayPal, we will reimburse your account in the amount charged if the payment has already been made.

Unless otherwise stated, the price with the "Suggested value" strike-through displayed for products on our website is based on the suggested retail price for the product provided to Zolari Trends by our vendor or the price advertised by another retailer for the same item or style (which may include a different color or pattern).

 

Zolari Trends did not previously sell the item for the strike-through price. We make no guarantees as to the accuracy or reliability of any such information because we sell our items both domestically and globally over the Internet. The strike-through pricing may or may not represent the going rate at any given moment or in every area.

Some of our sellers give Zolari Trends products that are either limited-edition or not generally available elsewhere. We utilize the words "Compare at" next to the strike-through to show your savings for products in this category that are similar to, but not identical to, products sold by other merchants.

 

This item's "Compare at" price is the vendor's estimated original retail value for a similar one that is being offered elsewhere and has the same quality, build, and material. Pricing is not an exact science, but our Zolari Trends team has years of retail experience and works with our vendors to decide whether an item is comparable based on the kind and quality of the material used, as well as the way it was built. Our "Compare at" price ultimately represents an estimate of the original retail cost of comparable goods.

When we offer a set of items, the strike-through price is calculated by adding the suggested retail prices for every single item in the set. The strike-through price for clothing products with larger sizes is calculated by averaging the prices across sizes.

The strike-through price for goods sold internationally from the United States to a foreign country reflects the exchange rate conversion from the U.S. strike-through price plus, if applicable, an adjustment for additional international surcharges that cover things like taxes, duties, and shipping. As a result, the strike-through price you see can be different from what you see at another merchant that determines foreign surcharges in a different way or for which no surcharges are applicable.

Based on a comparison of the strike-through price and the Zolari Trends price, the "you are saving" amount is calculated.

Nothing can replace your own comparison shopping, and despite the offered strike-through pricing data, we advise you to carry out your own independent research if this is a crucial consideration in your purchase decision.

Payment Conditions.

 

You agree to pay the Product Price, Delivery Fees, and any Applicable Taxes (defined below) for any Product you order on the Web site. The Product Price is the price that was in effect at the time you placed your order for the Product.

 

You hereby authorize Zolari Trends to automatically bill your credit card or PayPal account provided as part of the order process for such sums within five days of the order date.

 

Your payment will be handled in US dollars. Your final price may change if your order is being transported to a location outside of the US due to changes in currency exchange rates and any international transaction fees levied by your payment provider.

 

You will be solely responsible for paying all taxes (other than taxes directly imposed on Zolari Trends's business activity in a state, such as income taxes), fees, duties, and other governmental charges, as well as any associated penalties and interest, arising from the Product purchase ("Taxes") that were not withheld by Zolari Trends.

 

Except as expressly provided in Sections 2.1 and 2.3, no payments are refundable in any circumstance. Our Smart-pay option, which is detailed in more detail below, can be used to buy some products.

Orders (2.3). Receiving an order confirmation from us does not imply that we have accepted your purchase or that we are making a sale to you. We have the right to accept, decline, or cancel your order (in whole or in part) for any reason at any time after we receive it.

 

On orders placed using the same account, the same payment method, or the same billing or shipping address, we retain the right to impose a quantity cap on the available products. Resellers, dealers, and distributors are not permitted to purchase any products from us, at our sole discretion.

 

Before accepting any order, we might need to make more checks or gather more data. Prior to shipping (or shipping a portion of your order), your order is not accepted.

 

Despite what has been said thus far, you agree that if we cancel all or a portion of your order, your only recourse is for us to either (a) credit your credit card or PayPal account in the amount charged for the cancelled portion (if your credit card has already been charged for the order) or (b) not charge your credit card or PayPal account for the cancelled portion of the order.

2.4 Payments with PayPal. Payment for orders submitted using a PayPal account will be processed right away, and money may be taken right away from your PayPal account.

 

This in no way indicates that we have accepted your order or that our offer to sell has been accepted. According to Sections 2.1 and 2.3, we reserve the right to reject or cancel your order. Nothing in this Section modifies or amends anything in any other Section of this Agreement.

2.5 Shipping Guidelines All Zolari Trends delivery dates are merely estimates. Zolari Trends retains the option of making installment deliveries. When your item has shipped, Zolari Trends will send you an email, and you can check your order's details and shipping & handling information on your Zolari Trends My Account page.

 

We ship internationally to many different countries, including Canada, Australia, and the US (including Alaska, Hawaii, and APO/FPO/DPO locations). Upon Zolari Trend's delivery of the purchased goods to the carrier at the shipping point, the customer will acquire legal ownership to, the right to possess, and the risk of loss, damage, or destruction of the goods.

 

A client may be the importer of record for some products shipped straight from China to the United States by U.S. Customs and Border Protection. Furthermore, if your order is being delivered to a location outside the US, you will be the importer of record for those particular goods.

 

Despite the aforementioned, Zolari Trends will nonetheless issue refunds for products that are damaged, as specified in Section 2.6(c).

Return Policy (2.6)

American clients

(a) The return policy. Only items marked as returnable on the product information page or as permitted by Section 2.6(c) will be accepted by Zolari Trends. Your only and only option when Zolari Trends determines that your product was returned in accordance with Section 2.6 is a store credit in the amount charged for the relevant product, with the caveat that the credited amount will not include the relevant Delivery Fee, which is nonrefundable.

 

The credited amount will also be reduced by any necessary return shipping and handling costs. Return shipment expenses are not eligible for promotional shipping discounts. Gift cards are the only other items that can be purchased using store credits in the future on the website.

(b) Transactions. Exchanges of Products are not permitted by us.

(c) Products with damage. Zolari Trends will only accept returns for a full refund if the Product is received damaged ("Damaged Product"), and only in accordance with the return guidelines listed below.

 

Zolari Trends will either (a) issue a refund to your credit card or PayPal account in the amount charged for the Damaged Product (if your credit card or PayPal account has already been charged for the Product) or (b) not charge your credit card or PayPal account for the Damaged Product once it has been confirmed by Zolari Trends that you received a Damaged Product that was returned in accordance with the return procedures outlined below. The appropriate Delivery Fee will be included in the refund amount.

Return procedures (d). An applicable fee for return shipping and handling will be deducted from your refund for any returns of eligible products that are started within 30 days of the product delivery date. It's possible that the shipping and handling charges for returns will be more than what Zolari Trends actually paid the carrier to send the item(s) back to Zolari Trends.

 

These expenses can include labor and material costs, packing costs, and restocking fees. In compliance with any additional instructions obtained by contacting customer support, all returned Products must be undamaged (i.e., not worn, washed, damaged, or altered), in the original packing with the original tags attached, and returned within the specified time frame.

 

By reading the details on the Product page or contacting Customer Service at info@zolariventures.com, you can learn more about return eligibility and associated expenses.

 

A Zolari Trends shipping label will be provided to you once you've started a return so you can send your item(s) back. Use this label to send the item back.

 

Unauthorized returns will not be reimbursed or credited to your account, and we reserve the right to handle or discard those products in any way we see suitable.

International clients

(e) Returns from abroad. We firmly believe that you will adore your order. Any problems with your order should be reported to info@zolariventures.com.

Smart-pay Purchases (2.7)

A smart-pay payment option.

With the "smart-pay" payment option, you decide to make several little payments rather than one large one in order to purchase a Zolari Trends item. By choosing this option at checkout, you authorize us to charge each Smart-pay to the payment method you used to make your initial Smart-pay or, in the event that we are unable to process a charge using such payment method, to any credit card we have on record in your Zolari Trends account.

 

You acknowledge that at least one working credit card with an expiration date no sooner than 20 days following your most recent payment due date must be kept on file with Zolari Trends.

 

Within five days after the order date, the first Smart-pay will be charged, which will include all relevant taxes and shipping and handling costs. Due to the inclusion of any applicable taxes and shipping and handling charges, the initial Smart-pay will be more than any subsequent Smart-pay.

 

Approximately every 30 days following your initial payment, the remaining Smart-pay(s) will be charged. If you fund a Smart-pay with a credit card or other credit product, the issuer of your credit card or other credit product may assess you interest in connection with the transaction.

 

The Zolari Trends Smart-pay option does not require you to pay interest in order to use Smart-pays; this interest is distinct from that option.

Smart-pay eligibility (b).

On the item's product detail page, you may see if a product qualifies for the Smart-pay option. Zolari Trends reserves the right to decide whether a product qualifies for the selection.

 

If the total cost of all Zolari Trends products in the customer's order is greater than the minimum amount required during limited-time promotions, the customer may be given the choice to pay for each Zolari Trends product using Smart-pay.

 

Smart-pay cannot be used to purchase gift cards, nor can it be used to pay for things using prepaid or gift cards. Express checkout with Apple Pay orders do not support smart-pay. Whether you decide to use the Smart-pay feature or pay in full at the checkout, all promotional discounts (such as a percentage discount) will be deducted from the initial subtotal.

 

Any advantages or discounts that are not accessible for payment in a single payment are not yours if you use Smart-pay as a method of payment. You consent to receiving advance notice of a Smart-pay's amount only if the amount will change, but you also acknowledge that (i) the first Smart-pay will be higher than any subsequent Smart-pays because any applicable taxes and shipping & handling fees will be included in the first Smart-pay, and (ii) the final Smart-pay may be less than the amount shown on the product page if the full product price is not evenly divided by the number of Smart-pays.

 

Zolari Trends must approve any usage of Smart-pays to pay for an item. InZolari Trends's exclusive discretion, customers may or may not be eligible for Smart-pays and other promotions, programs, or incentives. Outside of the United States, Canada, and Australia, the Smart-pay option is not accessible for purchases.

Changes are (c).

You must adjust your payment method under My Orders at zulily.com or by contacting Zolari Trends customer support if you need to have a future Smart-pay charged to a different credit card or payment method than the one you used to check out.

 

If your payment method is rejected when we attempt to charge it for one of the payments following the initial Smart-pay, we reserve the right to charge that payment method or any credit card we have on file for your Zolari Trends account to cover the declined payment for a period of up to 120 days following the date the payment was rejected.

 

Zolari Trends may pursue collection efforts on your behalf directly or through a third party if you don't submit a Smart-pay when necessary. Zolari Trends retains the right to deduct any credit balance from your account from any outstanding balance of any Smart-pays you have missed when due.

3 Web page

3.1 Permit. Zolari Trends thus grants you a limited, non-transferable, non-exclusive license to access and use, only for your own personal use, the shopping services and features made available on the Website.

 

This license does not grant you the right to access or use the website for any of the prohibited uses listed in Section 3.2, nor does it permit you to sell or otherwise exploit any of the website's features or material. Anytime and for any reason, Zolari Trends may revoke this license.

3. Some Restrictions. The rights granted to you in this Agreement are subject to the following restrictions: (a) you shall not license, sub-license, reproduce, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Web site or its content without the express written consent of Zolari Trends; (b) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Web site; (c) you shall not access the Web site in order to build a similar or competitive service, or to download, copy or collect content or account information for the benefit of another merchant; (d) except as expressly stated herein, no part of the Web site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without Zolari Trend's express written consent; and (e) you shall not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information or content (including images and text descriptions) of the Web site without Zolari Trends’s express written consent.

 

The conditions of this Agreement shall apply to any upcoming release, upgrade, or other improvement to the functioning of the website.

3.3.1 Modification. Zolari Trends reserves the right to change, pause, or end the Web site or any aspect of it at any moment with or without warning.

4. Ownership. You acknowledge that Zolari Trends and its licensor are the sole owners of all intellectual property rights in the Web site, including our rights to copyrighted content, patents, trademarks, service marks, and trade secrets (collectively, "Intellectual Property") (excluding any User Content), and that neither the limited license granted in Section 3.1 nor our provision of the Web site under this Agreement shall transfer to you or any third party any rights, title, or interest in or to such Intellectual P The United States Patents Nos. 7,558,807, 7,647,339, 7,873,665, 8,065,333, and 8,296,325 are licensed to use in part of the website. All rights not expressly granted by this Agreement are reserved by Zolari Trends.
 

Four User Content

User Content. "User Content" refers to all data and materials that a user of the website submits to Zolari Trends via any channel, including social media (such as Facebook and Twitter), or utilizes with the website (such as a user profile or a feedback submission).

 

Your User Content is entirely your fault. You take full responsibility for any risks connected to the use of your User Content, including any reliance on its completeness, accuracy, or usefulness on the part of others or any disclosure of your User Content that reveals personally identifying information about you or any third party.

 

You hereby affirm, represent, and warrant that (i) your User Content is your own, or that you have the appropriate licenses, rights, and/or consents to use it with the Web site in accordance with this agreement, and (ii) your User Content does not contravene the Acceptable Use Policy (defined below).

 

You are not permitted to claim or indicate that Zolari Trends is in any way involved in providing, sponsoring, or endorsing your User Content. Due to the fact that you (and not Zolari Trends) are solely accountable for your User Content, you run the risk of being held liable if, for instance, your User Content violates the Acceptable Use Policy.

 

You acknowledge that Zolari Trends is under no obligation to keep a copy of any User Content and that it provides no assurances that it will do so. Zolari Trends is also free to remove User Content at any time.

4.2 Permission. By providing your User Content to Zolari Trends or using it on the Web site, you automatically grant Zolari Trends an irrevocable, non-exclusive, royalty-free and fully paid, worldwide license to use, reproduce, distribute, publicly display and perform, create derivative works of, incorporate into other works, and otherwise exploit your User Content. You also grant Zolari Trends the right to grant sublicenses of the aforementioned rights, but only as necessary to include you.

 

You consent to permanently renounce all claims and assertions of publicity or moral rights, or attribution with regard to your User Content, and to cause such claims and assertions to be renounced.

Feedback (4.3). Your comments, communications, and recommendations will be treated by Zolari Trends as non-confidential and non-proprietary information. Therefore, unless we have a signed agreement with Zolari Trends to the contrary, we both agree that we won't share any information or concepts that we regard to be confidential or proprietary with Zolari Trends.

Acceptable Use Policy, number 5

Zolari Trends's "Acceptable Use Policy" is described as follows:

5.1 You acknowledge that you will not collect, upload, transmit, display, or distribute any User Content through the Web site that (a) violates any third-party right, such as a copyright, trademark, patent, trade secret, moral right, privacy right, or other proprietary or intellectual property right; or (b) is unlawful, harassing, abusive, tortuous, threatening, harmful, abusive, intrudes on another person's privacy, vulgar, defamatory, false, or intentionally misleading.

5.2 Additionally, you agree not to use the Web site for commercial gain or to: (a) upload, transmit, or distribute any computer viruses, worms, or other software that aims to corrupt or damage a computer system or data; (b) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other type of duplicative or unsolicited messages, whether commercial or otherwise; (c) harvest, collect, gather, or assemble illegally obtained information

5.3 We reserve the right (but have no obligation under this Agreement) to review any User Content, investigate, and/or take appropriate action against you, in our sole discretion, if you violate the Acceptable Use Policy or any other provision of this Agreement.

 

This action may include removing or altering your User Content, terminating your Zolari Trends Account in accordance with Section 11, and/or notifying law enforcement of your activities.

 

Additionally, if we determine that your User Content puts us or anyone else in danger, violates someone else's rights, causes them injury, or poses a threat to their safety, we have the right to remove it or change it.

 

We may access and divulge any information we deem necessary or appropriate, including your Zolari Trends Account username and password, IP address and traffic data, usage history, and your User Content, in order to comply with lawful governmental requests, subpoenas, or court orders or to safeguard our business and members.

Six Unaffiliated Websites and Other Users

Sites from Third Parties. The website may include links to or ads for third-party websites (collectively, "Third Party Sites"), including but not limited to social networking platforms like Pinterest, Facebook, and Twitter.

 

The Third Party Sites in question are not under Zolari Trends's control, and Zolari Trends is not liable for any Third Party Sites. Zolari Trends simply offers links to these Third Party Sites as a courtesy and does not examine, approve, monitor, endorse, warrant, or make any claims with regard to Third Party Sites, including with regard to the content or accessibility of any material found there.

 

You acknowledge that using any third-party websites is at your own risk. The terms and conditions, including privacy and data collection practices, of the relevant service provider apply when you link to a Third Party Site.

 

Before moving through with any transaction with a Third Party Site, you should conduct any research you deem necessary or suitable.

Others Users (6.2). All User Content on a Web site is exclusively the responsibility of each individual user.

 

You understand and accept that we are not responsible for any User Content and that we make no representations as to its accuracy, currency, suitability, or quality.

 

This is because we have no control over User Content, thus we take no liability for any User Content.

 

The interactions you have with other website users happen only between you and them.

 

You acknowledge and agree that any loss or harm arising from such interactions are not the responsibility of Zolari Trends. We are under no duty to get involved if there is a conflict between you and another user of the website.
